Alexander Stark gives a lecture

At the invitation of the Institute of Sino-German Law of the College, Prof. Alexander Stark from the School of Law of Leuphana University of Lüneburg gave a lecture on the Dogmatics between Factual Description and Normative Requirements: a Case Study of the German Federal Constitutional Court's Climate Protection Litigation Decision to the students on Xueyuanlu Campus on 26 Sept, 2023.


Deputy Director of the Institute Dr. Wu Yiyue moderated the lecture. Prof. Xie Libin, Associate Dean of the College, and Prof. Zhao Hong from the School of Law of CUPL were the commentators.



Stark started from the introduction on the growing trend of climate litigation in Germany and around the world, explored the ideas in  the context of the increasing importance of climate protection, citing the case Luisa Neubauer et al. v. Bundesrepublik Deutschland of the German Federal Constitutional Court.



In the comments section, Zhao said that Stark's explanation was very enlightening. She also had an in-depth exchange with Stark on the issues of standing as a plaintiff in climate litigation, the limitation of the state's protection obligations and the complexity of intergenerational freedom protection and trade-off. Xie said that Stark's presentation helped the audiences better understand the development of climate litigation worldwide and provided them with a new perspective on intergenerational justice; also, it was beneficial to the development of the doctrine of fundamental rights.



During the Q & A and exchange, the students actively participated in the discussion, comparing the similarities and differences between China's environmental protection litigation and Germany's climate litigation.
