“免责”还是“处罚”

摘要:
网络转载现象因“信息共享”的正当性而普遍存在,但转载文章因信息不实而导致侵害相对人名誉权的行为也时有发生。业界、学界和司法界目前在应对网络转载承担名誉权侵权责任的认识上存在严重分歧。在网络转载侵害名誉权责任承担上遵循“以处罚为主,适当免责”原则,在网络转载具有主观故意的情况下必须承担侵权后果,而如果转载网络只是因为过失造成侵权,则应引入“善意原则”免除侵权责任,不能对没有采访权的网站转载求全责备;制度上对转载注意义务的规范也应该提上日程,以司法合理的强制规范形塑业界规范的网络转载行为,预防网络转载出现的名誉权侵权行为。

Abstract:
The phenomenon of the network reproduced because of the “information sharing” legitimacy and widespread but reproduced in the article because of the information is not caused by the infringement of the relative person’s reputation right behavior also occurs. Industry, academia and the judiciary are currently in the understanding of the right to assume the right of reputation infringement of the network reproduced on the understanding of the existence of serious differences. Reproduced in the network infringement of reputation right responsibility follows the principle “to punish, appropriate exemption”. In the network reproduced with subjective intention one must bear the consequences of the violation. And if the network reproduced is only because of negligence, introduce “the principle of good faith” free in addition to tort liability, not without the right to interview websites perfection; system of reproduced attention obligation should also be put on the agenda, reasonable judicial mandatory norms in shaping the industry standard network reprint behavior and prevention network reproduces the right of reputation tort.
