国家法理论视域下高校教师的科研自由与教育职责

摘要:
教育承担着培养公民的使命,是国家法理论的重要课题之一。从国家教育的内容来看,存在着价值中立和非价值中立两种教育模式。在价值中立的模式下,国家并不奉行某种特定的世界观和价值观;在非价值中立的模式下,国家则明确奉行某种特定的世界观和价值观。我国宪法采纳非价值中立的教育模式。在此宪法框架下,高校教师在享有科研自由的同时,也负有开展社会主义教育的宪法义务。

Abstract:
Education, which is responsible for training citizens, is one of the major issues in the theory of state law. In terms of contents of national education, there are two models of education: value neutrality education and nonvalue neutrality education. Under the former model, the state doesn’t pursue any specific world outlook or values while under the latter, it follows clearly a particular world outlook or values. Since our constitution adopts the model of nonvalue neutrality education, college teachers in our country both enjoy research freedom and carry out socialist education as a constitutional duty.
