Abstract:
Internships are an essential part of vocational education.Students in Vocational schools enjoy personal rights, the right to labor security and the right to education during the internship.After analyzing 573 relevant adjudicative documents, it is found that the realization of their rights are in trouble.There are loopholes in the protection of personal rights, and the right to obtain labor security is impaired while the judicial remedy is restrained.Furthermore, the right to education is damaged and not subject to judicial review.The main reasons for the impairment of interns’ rights include the failure of universities and internship providers to sign tripartite agreements in accordance with the law, the illegal labor dispatch of students by labor intermediary organizations, and the nonworker status of the interns.Therefore, it is necessary to strengthen the supporting legislation of the Vocational Education Law, establish a multidepartmental collaborative enforcement mechanism, and broaden the channels for resolving internship disputes.
