教育法典对学生人格权的体系化保护

摘要:
保护人格权是现代法律的重要任务,人格权在公法、私法与社会法中均具有重要地位。而学生的人格权不仅具有人格权跨领域性的一般特点,还有学生个体与群体差异性等的特殊性。学生人格权的保护也具有特殊性,应当对之进行体系化保护。通过立法与司法实践的考察,这种保护可以将分散于现行法律中的相关规定集中于未来的教育法典中以实现全领域覆盖;同时避免相关规定的重复与冲突。实现学生人格权的体系化保护应当与教育法典的编纂相结合。教育法典与学生人格权的保护逻辑相通,在体系建构等方面相得益彰。在将来编纂教育法典时,要注重学生人格权的跨领域性和综合性保护,兼顾积极保护与消极保护、一般保护与特殊保护。保护体系应与法典的总分结构相协调,在总则中明确学生人格权的法律地位,在分则中兼采确定性规则与准用性规则之优点,力争形成详密的规范依据。

On the Systematic Protection of Student’s Personality Rights by the Educational Code

Abstract:
The protection of the right of personality is an important mission of modern law. The right of personality plays an important role in public law, private law and social law. The personality right of students has not only the general characteristic of crossterritorial personality right, but also the particularity of individual and group differences of students. Therefore, the protection of students’ personality right has its particularity, which means it should be protected by systematic approaches. Through the investigation of legislation and judicial practice, we find that this approach should be centralizing the protection rules which scattered in various laws with the future education code. In this process, we should try to cover the protection fields, and avoid the repetition and conflict of relevant regulations at the same time. The systematic protection of students’ personality rights should be combined with the compilation of education code. The education code and the protection of students’ personality rights share common logic, and promote each other in the process of system construction. When compiling the education code in the future, we need to pay attention to the characteristic of crossfield and comprehensiveness when it comes to the protection of students’ personality rights.We should also take account to positive protection and negative protection, general protection and special protection. The protection system should be coordinated with the general structure of education code. We should clarify the legal status of students’ personality rights in the general provisions,adopt the advantages of both deterministic rules and applicable rules in the specific provisions, and strive to form a detailed normative basis.
