智能时代的教育立法前瞻

摘要:
人工智能技术迅猛发展,但“十四五”至2035年期间,人工智能仍将处于弱人工智能阶段。人工智能给教育立法提供了新的场景,教育立法必须适应学习、教学和管理智能化的需要,也必须应对隐私权和受教育权被侵犯的风险。随着人工智能在教育领域的应用,教育法律关系发生嬗变:虽然人工智能无法成为教育法律关系的主体,成为教师或学生,但受教育基本权利衍生出了新的子权利——接受信息教育的权利。教育过程中的个人信息受保护、教育信息选择、获得智能教育设备、不被过度暴露、不受自动决策和获得电子证书等方面的权利,亟须《教育法典》确认。

The Prospect of Education Legislation in the Intelligent Era

Abstract:
With the rapid development of artificial intelligence(AI), there are endless predictions about the future of humankind. During the 14th FiveYear Plan period to 2035, AI will still be at the stage of weak artificial intelligence. AI not only brings a new stage for education legislation such as intelligent study, teaching and administration, but also challenges the right of privacy and the right to education.With the application of AI in the field of education, the legal relations in education law are also changing.AI can neither become a student nor a teacher in educational law. Both the right to education and the rights in education will change, and these changes should be reflected in a package of recommendations for the revision of the Education Law including the right to information education, protection of personal information, selection of education information, access to AI education equipment, no overexposure to screentime, not subject to automatic decisions, obtaining eCert and so on. These new rights need be recognized by the Education Code.
